"FOR TRADE BY OWNER" AGREEMENT

All participants understand that the "For Trade By Owner" program is a service that puts unlisted and For Sale By Owner (FSBO) property owners into contact with one another. The Kieran Group will serve as hosts for whatever conversations the participants require and request, and they will provide Real Estate purchase contracts if the participants decide to write offers for each others’ properties.

No written listing agreement exists between The Kieran Group and "For Trade By Owner" program participants. However, participants agree to pay The Kieran Group a fee of 2.5 % of their property’s sale price, IF and Only IF,  the "For Trade By Owner" program is the source of a buyer who closes escrow on the property.

The fee is paid by participants from their escrow proceeds. If there is no close of escrow, no fee will be charged to participants.

The participant is free to list their property for sale with The Kieran Group (inside Oregon or Washington) or with any other Broker at any time, and if so, further participation in the Trade Program can be canceled by either party. The participant also may sell to any Buyer not located through the "For Trade By Owner" program at any time and without a fee due.

If a "For Trade By Owner" program participant wants to pursue a trade with a homeowner whose property is listed for sale by any other broker, the "For Trade By Owner" program participant appoints The Kieran Group to represent him/her in pursuing a purchase of the listed property.

Each "For Trade By Owner" program participant grants The Kieran Group authority to release information on their property(s) to other, qualified "For Trade By Owner" program participants. Each participant agrees to the terms of this Agreement as a condition to receiving other participants’ property and contact information.
